Types of Theft Crimes

In Michigan, theft is generally referred to as “larceny.” Larceny is considered any action that involves stealing someone else’s property, including money, goods, deeds, receipts, and public records.

Misdemeanor vs. Felony Theft

The severity of your charges – and therefore your sentence if convicted – depend on the circumstances of the situation.

Factors that affect the charges you face include:

  • The value of the goods or services stolen
  • Whether you have any prior convictions
  • Whether any weapons were used to carry out the crime

You will face a misdemeanor charge if you commit petty theft – or larceny – of any goods worth less than $200, or second-degree theft of anything worth between $200 and $1000. Misdemeanor theft cannot be punished by more than one year in jail or a fine of more than three times the price of the stolen goods.

Similarly, there are two levels of felony theft. In Michigan, you could face up to 5 years in prison and a fine of up to $10,000 (or 3 times the value of the stolen goods) for taking property worth between $1,000 and $20,000. You could face up to 10 years in prison and a fine of up to $15,000 (or 3 times the value of the stolen goods) for taking property worth more than $20,000.
